Court Upholds Muhammad Nsereko’s Election as Kampala Central MP

Mengo Court Chief Magistrate Esther Nansambu has Thursday dismissed Fred Sentamu Nyanzi’s request for a vote recount for Kampala central citing lack of evidence.

This means Muhammad Nsereko remains the MP elect Kampala Central 2021-2026.

Background;

Fred Nyanzi the National Unity Platrform candidate went to Court Challenging Mohammed Nsereko’s win in the January 14th election.

He went to Court demanding a recount of all votes cast in the Kampala Central MP race on January 14th 2021. Nyanzi in his petition argued that at some polling stations, results on the DR forms were not corresponding with the number of voters.

He also argued that some of his polling agents were harassed and chased away without signing Declaration forms. However, the EC provided evidence that all forms collected at all polling stations had been signed by Nyanzi’s agents, centrally to his claims.

He further noted that there were an extra 2000 votes which could not be accounted for. However, Nsereko’s lawyers told Court that since the race had more than two contestants, the 2000 votes could have gone to any other candidate and not necessarily Nsereko.

Nyanzi wanted votes from Balikudembe Primary School, KCC Primary School polling stations, Seroma Parking Yard, All saints, Martin Road, Old Kampala SS, National Theatre, Nakivubo Road, Basajjabala Taxi Park, Kampala Library, Bombo Road among other polling stations recounted.

The petitioner’s lawyer George Musisi noted that due to malpractices and irregularities, his client was wrongfully denied his victory.

However, Court threw out the petition on grounds that it was a wastage of time and asked both sides to foot their costs.  

In the hotly contested election, Nsereko emerged a victor with 16,998 votes while Nyanzi who is also NUP President Robert Kyagulanyi’s brother, came second with 15,975.
